近几年来,随着我国经济的飞速发展,公路上的汽车数量猛增,随之而来的交通事故数量也呈快速上涨的趋势,酒后驾车引发的交通肇事更是呈高发态势。据《全国新闻联播》报道,今年1至8月,全国因酒后驾车肇事2162起,造成893人死亡,醉酒驾车肇事1044起,造成409人死亡。面对频发的酒后驾车交通事故,众人皆呼吁对酒后驾车的肇事司机要依法严惩不怠。与此同时,各地法院出现对类似的醉酒驾车交通事故不同定罪量刑的悬殊判决。因此,近期社会各界就醉酒驾车引发交通事故究竟该认定为交通肇事罪还是以危险方法危害公共安全罪这一问题展开了激烈的讨论。

从量刑上考量,根据我国刑法规定,交通肇事罪起点是三年以下有期徒刑或者拘役;肇事后逃逸或者有其他特别恶劣情节的,处三年以上七年以下有期徒刑;因逃逸致人死亡的,处七年以上有期徒刑。而危害公共安全罪,量刑起点是三年以上有期徒刑,最高可判处死刑。两者的量刑差距甚大,选择何种罪名直接关系到对违法者惩罚力度的大小。笔者认为因醉酒驾车引发交通事故应认定为以危险方法危害共公安全罪,理由如下:

一、醉酒驾车交通事故的罪名认定

(一)醉酒司机存在主观故意

禁止酒后驾驶,这是法律明确的禁止性规定。酒后驾车可能出事故也是一般人都应该具备的常识,醉驾人在喝酒前即负有预见到自己可能喝醉,影响其驾车能力、注意能力,可能造成交通事故的义务。有义务存在而没有去积极履行,放任自己的错误行为,放任危害不特定多数人人身财产安全的可能性的高度扩大化,这是对他人生命财产的`不尊重。从动机上看,喝酒前是能够事先预料到相应风险的,但心存侥幸、铤而走险,难道就可以全部归结为是对自己驾驶能力的自信,而不能说是存在一定的主观恶意吗?明知要开车,仍然主动喝酒或者被“灌”,难道就没有“明知故犯”的心理意思吗?因此,从司机们喝酒时起就可以判定其在主观上是出于放任状态的,那么应该说是间接故意犯罪,从而推出对醉酒驾车应认定为以危险方法危害公共安全罪。

(二)以交通肇事罪处罚过轻

我国酒后驾车现象之所以屡禁不止甚至愈演愈烈,主要原因在于对酒后驾车者的处罚太轻了,法律本身没有很好地发挥出应有的警示和惩戒作用。在过去的实践中,对于没有造成严重交通事故的酒后驾车司机只做一般的行政处理,往往不予处罚或者只是象征性地罚一些款了事。即使在惨剧发生后也只是一味地认为其主观上属于过失,危害性不大,从轻处理。这些“温柔”的惩罚举措使得司机们在喝酒时无所顾虑、放开胆量一饮而尽、不醉不休,而不去考虑酒后驾车可能酿成的恶果。刑法中规定的交通肇事罪是实害犯,其构罪要件中要求是发生重大事故,致人重伤、死亡或者使公私财产遭受重大损失。而危害公共安全罪是危险犯,只要行为人实施的行为足以危及到公共安全,即使没有造成严重的后果,也可以构成本罪。将醉酒驾车认定为危害公共安全罪,也就是把醉酒驾车的行为划定为一经发生就应该承担刑事责任,而不是等到危害结果发生后才来追究其责任。相较于认定为交通肇事罪而言,不给予喝酒司机存在侥幸心理的空间,加大了对醉酒驾车这一现象的惩罚力度,加强了法律的威慑力,更有利于从源头上遏制醉酒交通事故的发生,把危险扼杀在端起酒杯之前。

我国新《中华人民共和国道路交通安全法》第九十一条规定:饮酒后驾驶机动车的,处暂扣一个月以上三个月以下机动车驾驶证,并处二百元以上五百元以下罚款;醉酒后驾驶机动车的,由公安机关交通管理部门约束至酒醒,处十五日以下拘留和暂扣三个月以上六个月以下机动车驾驶证,并处五百元以上二千元以下罚款。从这一规定明显可以看出,我国正在逐步加大对醉酒驾车的预防和惩罚力度。但目前仍局限于行政执法上,要更好的遏制醉酒驾车造成的严重危害,警示潜在的违规驾驶司机,还应该延伸到刑法犯罪领域。

(三)其他国家和地区对醉驾行为处罚严厉

很多国家、地区对酒后驾车持“零容忍”的态度。在美国,醉酒驾车等行为属于严重犯罪。美国法律规定,因车辆机件失灵、故障、未看清标志驶入逆行、违章停车、避让不及时、雨雾天气妨碍视线等引发交通事故,属于过失行为,不构成犯罪;但酒后驾车、吸毒后驾车、驾车行驶闯红灯、超速4种行为属于故意犯罪,因为这是每个申领驾照的车主明知的禁令。① 日本刑法也于几年前增设了“危险驾驶致死伤罪”,具体包括酩酊驾驶致死伤罪、超速行驶致死伤罪、无技能驾驶致死伤罪、妨害驾驶致死罪、无视信号致死伤罪等五个罪名。②我国香港特别行政区在道路交通条例(第39条)中规定了醉酒驾驶罪;澳门特别行政区在刑法典 (第279条)中规定了危险驾驶道路上之车辆罪。③我国台湾刑法规定,服用毒品、麻醉药品、酒类或其它相类之物,不能安全驾驶动力交通工具而驾驶者,处一年以下有期徒刑、拘役或科或并科十五万元以下罚金。④可以看出,对醉酒驾车“零容忍”,采取严惩的态度是世界的大势所趋,是值得我国大陆立法机关考虑和借鉴的。。

二、酒后连环撞车的主观认定

当前不少人提出,对于酒后连环撞车,整个过程应该分解为?故意?和?过失?两个部分。醉酒驾车的行为人大多是认为自己酒后并没有完全丧失自我控制意识,具备一定的驾驶的能力,心存侥幸,自信不会出事所以驾车,如果在发生事故后没有逃逸,没有将他人的人身财产安全弃之不顾,可以推断出其主观上并非放任自己去撞人,因此对于第一下撞击,可以理解为过失。但如果撞击第一次后逃逸,说明其神智已经达到了思考的清醒度,在能选择的情况下,选择企图逃避法律制裁,放任自己在不具备安全驾驶的能力,可能引发与来往的车辆或行人相撞,危及不特定多数人的生命、健康或公私财产安全的严重后果发生。这时从一般人的角度看,是出于应该预见的,其主观心态已明显转变成了间接故意,因此接下来第二次、第三次撞击应认定为主观上的故意。对此,笔者不敢苟同首先,正如本文所陈述的观点,醉酒驾车的定性从司机喝酒时起就应认定为是一种主观的放任,是间接故意,不存在将一整个醉酒驾车事件一分为二的基点。如果按照上述观点,将事件过程一分为二的方法去认定,明显是把醉酒驾车的定性起点推延到了惨剧发生之后,是不够科学的。

其次,该种认定方法给人一种凭后果选择罪名的感觉。如果醉酒司机只撞击一次,因其撞击次数少,可能导致的结果损害性较小,故划定为过失,为交通肇事罪。醉酒司机撞了两次、三次,造成的结果更严重,故划分为危害公共安全罪。同样是酒后驾车,仅因为造成人员伤亡的结果严重程度不同而作不同的定性,这显然是不合理也不合法的。

另外,根据刑法第133条的规定,犯交通肇事罪的,处3年以下有期徒刑或者拘役;交通运输肇事后逃逸或我国醉酒驾车的探讨者有其他特别恶劣情节的,处3年以上7年以下有期徒刑;因逃逸致人死亡的,处7年以上有期徒刑。由刑法的规定我们可以看出,刑法立法的原意是把交通肇事后的逃逸行为作为加重量刑的一个事由,而并非作为判断、区分主观恶意甚至罪名定性的元素。从遵循立法原意出发,应在认定醉酒驾车为危害公共安全罪的前提下,将行为人在事故后是否逃逸,是否积极配合交警部门处理事故等不同表现作为影响量刑的标准之一。正如最高人民法院审判委员会专职委员黄尔梅指出,人民法院应当正确适用法律,坚持宽严相济的刑事政策,充分发挥刑罚惩治和预防犯罪的作用,依法严惩醉酒驾车犯罪。⑤将醉酒驾车定性为以危险方法危害公共安全罪从我国目前对醉酒驾车现象惩罚力度的需求上来看是更符合的;从发挥预防犯罪作用的角度看也是更有效的。当然,法律的规制毕竟是一种强制措施,具有消极性。只有司机们的自觉性提高了,才能真正杜绝酒后驾车,营建一个安全的和谐社会
